Terms & Conditions

  1. 6th Position's Studio Policies (www.6thposition.com.au/studio-policies) and information on how to participate in 6th Position's classes, programs and/or activities (hereafter collectively referred to as 'class/es', 'program/s' or 'activity/ies'), including electronic and hard copy information, form part of these Terms & Conditions. Participation in 6th Position activities will be considered acceptance of these Terms & Conditions, and any ongoing updates of these Terms & Conditions.
  2. To participate in 6th Position activities, participants agree to register their attendance and provide 6th Position with their full name, phone number, email address, postcode and next of kin contact details in case of emergency.
  3. All information provided must be true and correct at the time of registration.
  4. Once entered, registrations are not transferable to another person.
  5. Late or incomplete registrations for activities may be deemed as ineligible for consideration to participate in a class.
  6. By providing information to support a registration, the participant warrants they either own the material or have acquired sufficient right to use the material for the purpose of the program and agree to indemnify 6th Position against any loss or damages caused by breach of this warranty.
  7. The decision made by 6th Position to accept a participant into the program will be on a “first in” basis and/or suitability of the participant for the program, provided the registration is not late or partially completed.
  8. Classes may be physically strenuous and participation is voluntary, based on a participant’s own assessment of their fitness, health, ability to participate and understanding of the class requirements, activities and expected outcomes. Participation is based on an understanding and knowledge there is a risk of personal injury or death.
  9. By entering the premises, participants agree 6th Position is in no way responsible for personal injury or death. Participants are responsible for ensuring one’s own physical and mental health for, during and after classes including injury rehabilitation and general post-class care.
  10. Fees form part of the registration process and are due prior to participation in an activity. Once paid, fees are final, non-refundable, non-transferable and non-extendable beyond their specified expiry. 6th Position's policy for payment and refunds is explained at www.6thposition.com.au/studio-policies.
  11. By participating in 6th Position's classes, activities and/or programs, you are consenting to being photographed and/or filmed during classes, activities and/or programs. Still and/or video footage may be used for the following purposes, including, but not limited to, public promotion of 6th Position (e.g. advertisement) and/or 6th Position collaboration with a third party/ies (e.g. collaboration with an artist to create a dance related work). By participating in 6th Position's classes, activities and/or programs, you are also consenting to 6th Position providing still and/or video footage of you to any third party/ies directly involved in public promotion of and/or collaboration with 6th Position.
  12. 6th Position will not be responsible for any problems or technical malfunction of any network or lines, servers, providers, computer equipment, software, traffic congestion on the Internet, etc. including, but not limited to, any injury or damage to participants or any other person's computer related to or resulting from registering for, participating in or downloading any materials to enable full participation.
  13. 6th Position reserves the right, at any time, to verify the validity of a participant’s registration and to reject or disqualify a participant from participating in any classes, activities and/or programs.
  14. The participant agrees to indemnify 6th Position against any injuries or damage to persons or loss or wrongful death or loss or theft of property, whether caused by negligence or otherwise while participating in the activities provided throughout the program and associated activities, from the first registration.
  15. Information provided by 6th Position, Dance Teachers and 6th Position staff is given for reference purposes only and to assist with general understanding. Before applying any information, participants should seek professional advice from experts who understand the personal circumstances of each individual.
  16. 6th Position accepts no responsibility for inability or failure to register for classes.
  17. If for any reason the program is unable to run as planned, including causes beyond the control of 6th Position, the program may be cancelled, suspended or modified.
  18. The participant agrees to indemnify 6th Position against any loss or damages caused by a cancellation, suspension, modification or withdrawal of the program where a sponsor, partner or supporting individual or organisation fails to fulfill their duties.
  19. Any 6th Position class, program and/or activity may be withdrawn at any time without notice.
  20. These Terms & Conditions may be altered where necessary, with the most current version available on the 6th Position website at www.6thposition.com.au/terms-conditions.
  21. Where a participant is a minor/dependent/child, as defined by Australian law, a parent/carer is accepting these Terms & Conditions on their behalf.
  22. Modifications to information, infrastructure, program delivery and/or content may be made at the discretion of 6th Position. 6th Position cannot guarantee modifications to information, infrastructure, delivery and/or content will ensure full participation for everyone.
